CONSENT TO ELECTRONIC RECORDS

1. Introduction

This Consent to Electronic Records Agreement ("Agreement") applies to all disclosures, notices, and communications (collectively, "Records") that Avid Acceptance LLC ("Company," "we," "us," or "our") may provide in connection with a retail installment sales contract ("Contract") that we may purchase from a dealership where you have financed the purchase of a vehicle.

By agreeing to this document, you consent to receive Records in electronic form instead of paper copies. This consent applies to all communications related to:

Pre-purchase Disclosures: Any notices related to the review or approval of the Contract. Regulatory Disclosures: Any legally required notices under the Equal Credit Opportunity Act, Fair Credit Reporting Act, Gramm-Leach-Bliley Act, and other applicable laws. Contract-Related Communications: Any updates, account-related information, or other materials related to the Contract, if purchased by Avid Acceptance LLC. Adverse Action Notices: If the Contract is not purchased, you may receive a notice electronically. This consent does not obligate Avid Acceptance LLC to purchase the Contract and does not constitute financing approval. It simply allows us to provide required communications electronically. This consent complies with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) (15 U.S.C. § 7001 et seq.), which allows required disclosures to be delivered electronically.

2. Scope of Consent

By agreeing to this document, you acknowledge and agree that: You will receive electronic Records related to the review, purchase, and servicing of your Contract. Your consent applies to all communications regarding this transaction, whether or not Avid Acceptance LLC ultimately purchases the Contract. Electronic Records may be provided via email, an online portal, or other electronic means.

3. Hardware & Software Requirements

To access and retain electronic Records, you must have: ✔ A computer, smartphone, or tablet with internet access. ✔ A web browser (Chrome, Edge, Safari, or Firefox). ✔ A valid email account. ✔ Software to open PDF files (e.g., Adobe Acrobat Reader). ✔ A printer or storage device if you wish to retain copies. If you cannot meet these requirements, you must notify us to request paper copies.

4. Right to Paper Copies

5. Right to Withdraw Consent

You may withdraw your consent to receive electronic Records at any time by contacting us at the details above. Withdrawal does not affect any previously provided Records. Certain transactions may require electronic Records to proceed. If you withdraw consent, paper documents may be required, which could delay processing. Withdrawal requests are processed within 5 business days.

6. Updating Your Contact Information

You must keep your email and contact details current. To update your information, you can: Log into your online account and update your profile, OR Contact our support team at info@avidac.com or 1-888-777-9190. We are not responsible for undelivered Records due to outdated contact details.

7. Confirmation of Consent

By clicking "I Agree," checking a box, or signing electronically, you confirm that you: Have read and understand this Agreement. Consent to receive electronic Records for all communications related to the review and potential purchase of your Contract. Meet the hardware and software requirements outlined above. Know you can withdraw consent at any time. If you do not consent, you must notify Avid Acceptance LLC before completing any transaction.

8. Changes to This Agreement
